Appeals Court Denies Notre Dame’s Challenge to Health Law’s Contraception Mandate

The high court had ordered the judges in the Seventh Circuit in March to reconsider Notre Dame’s case, which they previously rejected. Notre Dame has been unwillingly using the alternative system for more than a year after courts in Seventh Circuit previously rejected its preliminary injunction requests.

“The Seventh Circuit’s decision today does not do justice to Notre Dame,” said Eric Rassbach, senior counsel of the Becket Fund for Religious Liberty, a group supporting dozens of similar legal challenges. “The cases will continue as they have. Every time these issues have reached the Supreme Court, the government has lost and the religious plaintiffs have been granted relief.”
