And should one or more of the contraception cases make it to the Supreme Court, Kyle Duncan, general counsel for the Becket Fund for Religious Liberty — which represents several of the challengers — said he’d bet the justices could be willing to review it.

“Historically, they have a keen interest in religious liberty issues, especially when it comes to government coercion of conscience,” he said. “If one or more of these cases gets up to the Supreme Court, this would be the next big Religious Freedom Restoration Act case.”
